Jacob, Brian and Josh make plot to rob a bank. Brian and Jacob will be carrying the guns into the bank. On their way to the bank, Brian and Jacob recognize Sophia walking down the street, who they knew to be a good driver from their high schools days. She used to race cars and won lots of prize money, and they knew she would be a good get a way driver. They grab her and her son from behind, blindfold her and pull her into their vehicle, but don’t allow them to see their faces. They drive four blocks to the bank and tell Sophia what she will be required to do or face the consequences of grief from the death of her son whom they had dropped off on the way to the bank with someone else. Josh remained in the car with Sophia during the event to make sure she did not get away. Upon arriving at the bank, Brian and Jacob raise their guns, point them toward the direction of customers and employees, and demand money from the tellers. Meanwhile, a police officer sitting with the bank manager gets up and orders Brian and Jacob to lower their weapons, who subsequently refused. The police officer shoots toward the two robbers, hitting Jacob and killing him. A dangerous shootout ensues and one of Brian’s bullets hits and kills a customer. Brian and Josh run out of the bank and jump into the get-a-way car where Sophia and her son are sitting. The police officer comes out of the bank and starts wildly spraying bullets at the car because, presumably he doesn’t see Sophia inside. Sophia, afraid for her and her son’s life pulls out her concealed carry handgun and takes aim at the officer. She shoots him in the arm but does not kill him. With a gun to her head, she is commanded to drive off by the bad guys. What charges could the prosecutor bring? Could any of the parties be successful in defending against the charges? Explain and analyze fully.
