Please review the article and provide your opinion on the issue, as well as bringing in one source of your own to discuss.

1. In the article, it talked about a woman who started a fight and put her and her baby in danger. She ended up shot in the stomach and lost the baby in which she ended up charged with manslaughter. The charges were dropped and in further investigation, pregnant women usually are charged in Alabama because of the 2006 Meth lab era they had where children were in danger. Then the law extended to fetuses which was great because there are pregnant women who do drugs while having the baby inside them. But now prosecutors are trying to extend it a little further and use the Marshae Jones case as an example which ended up failing. Then again not knowing the full story of why she fought more than likely she had justification for why she did have the altercation. Then for my article, it stated how there are 3 states who permit pregnant women to be arrested and Alabama is one of them. My article also further explained how legal prescriptions were in the category of the nation’s harshest law against drugs during pregnancy but are now in the works of being changed. This is because in 2014 Hana Ballenger use drugs prescribed by her doctor when her baby was tested and they popped up in his screening she was arrested. Then she was charged with a felony that carried 20 yrs in prison and her son was taken away from her. While reading this it seemed really far-fetched because something as little as ibuprofen can show up and women are arrested. Then it’s terrible because her baby was taken from her these laws are really harsh and should be let up on especially by the Supreme Court.
2. The topic discussed in this article was about a law that passed in Alabama in 2006, called the Chemical Endangerment Law. The purpose of this law being passed was to help protect children from exposure to drugs, especially from home meth labs. According to the article, there was a huge problem of meth labs in Alabama during that time and when raids would be conducted they often found children sleeping close to the toxic labs. The law’ s intention was to make the exposure of toxic chemicals into a crime and more serious charges such as causing a child injury or even death could result in a longer sentence, of 99 years. After this law passed, many prosecutors started using this new law to put pregnant women in prison who were using any type of drug. Prosecutors argued that the womb was considered an environment in which the fetus was being exposed to drugs just like the children already born when exposed to meth labs. But, in a unique case, the article also mentioned how a pregnant woman who provoked a fight and was shot, caused the death of her unborn child because she was involved in a fight. Prosecutors decided to use the Chemical endangerment law against her, she ended up getting indicted but her case was later appealed and charges were dropped because her case wasn’t that of chemical endangerment. The article I choose, discussed how in different states the requirements for the evidence of drug exposure to the fetus or newborn, varies in order to report to authorities or child welfare systems. It mentions how in South Carolina it relies on a single positive result and how Texas requires that an infant must be ‘addicted” to a substance. It also mentioned that taking legal actions towards pregnant women who consumed drugs wasn’t always effective to deter the use of alcohol/drugs and that providing them with treatment services would serve them better than legal action.
