Hello Class,

In viewing the question related to online advertisement and its invasion of privacy, I would be concerned especially if the content of the ad was derived from pages that I visited. It is a known fact that cookies are embedded to enable better interactions with websites, but what happens to the data that gets captured through web analytics methodologies? Let’s connect this with AdSense to delve deeper so as to gain an objective answer. AdSense scans webpages’ contents and utilizes the returned information to reveal the ideal advertisement that will best serve visitors to the site. I would not say that advertisement on a webpage is an invasion of privacy because one criteria that must be met by websites before AdSense allows for the placing of ads, is that there should be legally compliant Privacy Policy on the site (Privacy Policy for Google AdSense, 2021). An agreement with a privacy policy prior to visiting a site would therefore mitigate an invasion through the attaching of any advertisement.

Under the copyright law’s work for hire doctrine, the source code belonged to the employer and as such it would be illegal for Bryce to remove or tamper with the code without receiving permission from JustMed (employer). Section 101 (1) of the copyright laws defines “work made for hire” as a work prepared by an employee within the scope of his or her employment (Copyright Basics, n.d.). Therefore, even if Bryce was responsible for the source code, authorship still went to the employer. Also, not being the designated author of the work meant it was illegal to use the source code for a new application or change the copyright notice.

If I was in Bryce’s position, I would consider not only the copyright laws, but work ethics before attempting any negotiations. Additionally, I would request a meeting with Joel just regarding the findings (disparity in shares, not being viewed as equal partners). Overall, it could have been just a case of misunderstanding and/or miscommunication between the brothers-in-law.
