Utilizing the two cases you just briefed for Assignment #6 as well as the Fact Pattern that has now been posted on the Course Content page, write a detailed Memorandum of Law answering the questions posed below.
The Memo should be at least 4 or 5 pages (1-inch margins) in length in Times Roman 12 point font.
Questions to address in your memo:
1. Does the conduct complained of amount to Hostile Work Environment Sexual Harassment? Why or Why Not? (Analyze the elements needed for Hostile Work Environments)
2. Did the conduct at issue rise to the level of Quid Pro Quo Harassment as defined in the cases? Can the University be held liable for the conduct at issue?
In addressing these questions you will need to discuss and make reference to the facts. Do not retype the fact pattern. Rather, in your memos begin with a brief statement of facts that would be applicable to the questions. You need to present the facts in a paragraph giving the reader a brief indication of what transpired concisely and clearly. Picking and choosing relevant facts is a fine art and part of the legal writing process.
For example, if the facts say a worker (X) began employment on December 1, 2006 and left on November 20, 2010 should you include that? Is it relevant to whether the conduct was sexual harassment? It might be. It might not be. Can you find another way to work in the length of time such as X was employed by Y for 4 years?
Think about each fact you include and whether it is relevant to the issues being addressed. In my example, the length of time might be relevant, but the actual months, December and November, by themselves that X started and ended employment probably aren’t.
