Description
Here is a contract remedies problem:
Baker entered into a contract to purchase a lakefront home on Lake Tahoe near Homewood from Able. The price was $3,000,000. The written contract was fully signed.
Able decided that he could not sell the home. He liked the house too much and he did not want Baker to have it.
Baker was very upset. He suffered emotional distress about not being able to buy the house of his dreams.
Baker sued Able.
At trial Baker produced evidence that the value of the house is $3,500,000. Baker also produced witnesses to testify that Able did not perform the contract to sell the house to Baker because Able just did not like Baker.
Two Questions to answer very briefly:
(1) What damages could be awarded to Baker for breach of contract?
(2) What other remedy is available to Baker for the breach of contract and why?
