In Federalist # 78, Alexander Hamilton outlines his opinions on both the “mode” of appointing judges and the “tenure” these judges should enjoy once they are chosen. Explain (in some detail) (a) why Hamilton believes the Judiciary branch of the new United States government is the least powerful (compared to the Executive & Legislative branches). (b) how Hamilton envisions the Judiciary should resolve the predicament where two contradictory laws apply to a specific situation. (c) why the independence of the Judiciary is absolutely critical to its success. (d) why the permanency (or long terms) of judges is so critical to the Judiciary’s effectiveness.
