Hi everyone,
I believe that the parking lot owner is responsible for Mac’s car being stolen, because based on bailment principles the parking lot owner must return Mac’s car, and it is the parking lot owner’s duty to protect and preserve Mac’s car from theft or any other damage. Mac did nothing wrong. The negligence of the attendant and leaving the parking lot unattended all time was to blame for the theft of the Mac’s car.
BAILMENT
- Bailment: An arrangement in which the rightful possessor of personal property gives the property to someone who has agreed to hold the property and who has a duty to return it.
- Bailor: Someone who is in the rightful possession of property who gives the property to someone else to hold.
- Bailee: Someone who is in the possession of someone else’s property, and who agrees to accept the property and has a duty to return it. (Business Law and the Legal Environment, “Chapter 31 PPT. 10”).
Duties of bailee to the bailor:
- Taking reasonable care of the property.
- Gross negligence contributes to liability.
Gross negligence: Reckless disregard of a duty (in bailment). (Business Law and the Legal Environment, “Chapter 31 PPT. 11”).
