Since there is so much discretion allowed in the criminal justice system, there are stereotypes that exist throughout the whole system. This is namely true for stereotypes regarding prosecutors charging acquaintance rape. Acquaintance rape is a rape that is perpetrated by someone the victim knows, whether it be a significant other or an actual acquaintance (Persson et al., 2022). These are often treated much less seriously than rapes committed by a stranger (Spohn et al., 2001). This is likely because these acts of rape are often a he-said-she-said situation in which the evidence is not substantial enough to prove a rape occurred. In addition to this, it is more likely in these cases that the victim is not actually a victim and just wants to get back at the alleged perpetrator. This leads to prosecutors not treating these cases to the extent they should in comparison to cases involving strangers.

I would suggest that prosecutors do not factor in the relationship of the victim to the suspect when determining whether or not to prosecute the suspect. This would be a lot easier said than done, so I would also suggest that the District Attorney’s office block out the relationship of the victim to the suspect prior to determining if there is enough evidence to prosecute. This would give the prosecutors no choice but to treat every case of sexual assault and rape the same. Furthermore, I would also implement required trainings in which prosecutors will understand how their discretion can turn into stereotypes, as well as how this affects victims and suspects. This would likely help them to understand that they are not the only ones affected by their decisions.
