The following cases should be briefed — 

Harris v. Forklift Systems, Inc., 114 S.Ct. 367 & Meritor v. Vinson, 106 S.Ct. 2399. 

(Full citations should be included in your briefs) Both cases involve the issue of sexual harassment and contain several (numerous) issues. Briefs should address all of the major legal issues presented, be thorough, and done in the format (with the headings) listed in Assignment #5. You will be using your briefs to draft a Memorandum of Law for Assignment #7. The more time and effort you put into creating the briefs, the easier it will be for you to write the Memorandum of Law.

There are several issues in each case which should be separately addressed in your briefs, along with the Court’s reasoning for determining each of those issues. Before drafting the briefs, review the sample briefs posted in the Sample Answer/Student Work file on Negligent Assault which will be made available after March 7th.

Briefs should be a minimum of 2 pages, single spaced (except between headings – briefs that are substantially shorter will lose points – there is a lot to write about here). Procedural history should recount where the case started, where and who appealed to the next level, and then who appealed to the Supreme Court & why – what were they seeking? Facts should contain a thorough rendition of all the relevant facts. There are several issues in each case. They should be listed individually in question form. The Reasoning Section should address each issue individually, and explain what the Court’s rationale was for reaching the conclusion it did on each of the issues.
